Lucia Ancona Lopez de Magalhães Dias is partner at Magalhães & Dias law firm and head of the consumer and regulatory law area.
Over the past two decades, Ms Magalhães has been engaged with enormous success in the most important leading cases in the field. She represents major corporations in administrative and judicial proceedings (litigation) related to the assessment of advertising campaigns, promotions, trade policies, children's advertising, labelling, allergens and GMO, unfair competition, electronic commerce, several safety recall procedures (from planning to execution, including media planning, drafting requirements and briefs to consumer and health authorities and follow-on litigation), and individual and collective compensation claims (complex class actions), as well as regulatory affairs.
She also advises and represents several business and industry associations, such as the Brazilian Advertisers Association (ABA) and the Brazilian Food Industry Association (ABIA), on direct actions of unconstitutionality, public consultations and draft bills on issues related to consumer, safety and standards regulation, especially regarding labelling claims, children’s advertising and food safety.
Ms Magalhães has been also very active in cases before both the Brazilian advertising self-regulation body (CONAR) and consumer protection bodies (PROCONs, SENACON-DPDC-MJ, state and federal Prosecution Offices, ANVISA, MAPA, ANATEL, among others).
Lucia Ancona Lopez de Magalhães Dias holds a PhD in consumer law from the University of Sao Paulo (USP) and is also guest professor at renowned institutions and author of several publications, including “Advertising and Law” ("Publicidade e Direito", currently in its third edition), which is regularly referenced by the courts in cases involving advertising and unfair competition.
Ms Magalhaes’ strong stakeholder engagement and credibility before authorities and scholars are very much praised by clients. She appears as former director of consumer relations at IBRAC and currently a member of its Consumer Committee, as well as Director of Brasilcon (Brazilian Consumer Policy and Law Institute). In 2020, she was invited and also has coordinated important publications in the field to celebrate the 30th anniversary of the Consumer Defence Code.
