Biography
Gabriel Nogueira Dias is both name partner and the current managing partner at Magalhães e Dias – Advocacia. He became equity partner of the firm more than 10 years ago, but he has been working with antitrust and regulatory law since 1996, being responsible for such areas in the firm.
He has a law degree from the University of Sao Paulo (USP) (1998), a master of laws (LLM) and a PhD in law from the University of Bonn Law School, Germany (2002/03) (published by Mohr Paul Siebeck).
As a former adviser of the President of CADE (Brazil's Economic Defence Administrative Council) in 1997/98, he helped the Brazilian antitrust authority in the drafting of some of its first and most important regulations.
Mr Dias represents major corporations in complex administrative and judicial proceedings in the economic law field. He is known by his clients for his strong legal foundation, accurate strategic approach, and fast and pragmatic solutions designed for extremely intricate situations. Some of his clients call him the antitrust memory of the legal departments of their companies, since their long-lasting relationship provides him with the full knowledge of the company’s legal background.
He has been involved in several complex merger reviews (eg, AmBev, Bayer, Booking, Hapvida, Ipiranga, Nestlé, PepsiCo, Suzano, Unilever, Warner and others) and conduct cases (eg, AmBev, BAT - Souza Cruz, Booking, Ipiranga, Lafarge, M Dias Branco, Pirelli, Salinor, Unilever, Whirlpool and others). He was the first lawyer to advise, draft and sign a cease and desist agreement in horizontal conduct investigations (cement sector), when the regulation for such agreements was enacted in Brazil, in a case that later broke the record for fines applied by the Brazilian authorities. Since the notorious Nestlé/Garoto case, he is involved in the most important judicial cases discussing antitrust matters, whether to annul CADE’s administrative decisions or debating the recovery of damages.
He also advises several business and industry associations, such as the Fuel and Lubricants Distributors National Union (SINDICOM), Brazilian Advertisers Association (ABA), Pulp and Paper National Association (IBA), Brazilian Sodas and Non Alcoholic Beverages Association (ABIR), Brazilian Food Industry Association (ABIA) and the National Association for Fertilizers Diffusion (ANDA) on issues related to antitrust and competition law.
